Real estate laws for brokers in California will be covered. Written buyer-broker agreements are now required, before showing properties. Mandated disclosure of dual agency is required and the disclosure must specify that compensation will be outlined in these types of agreements, rather than solely being listed in the MLS. This all started and is stemming from concerns over commission-sharing practices. Brokeres have a fiduciary dutiy to all their clients, and must maintain proper licensing and education, as per the California DRE.
Employment Laws for Real Estate Agents
This webinar focuses on employment laws that real estate agents must follow. These laws are covered under the Labor Standards Act (FLSA) and Caifornia Business and Professions Code when brokers are also acting as HR professionals, being that they have employees. In regard to the sales or purchase of real property, the California Real Estate Codes and laws implementd by the Department of Real Estate will prevail. In regard to employees, it is of vital importance for employees to be classified correctly to avoid legal violations that are not in compliance with labor/management laws.
